    RBG couldn’t run out the clock. Now Trump and McConnell will ram through another horrible candidate cementing a 6-3 conservative majority moving forward for decades.

    Huh? What did missing have to do with Ginsburg dying? Either way, whoever was the dem candidate her death results in the same. You make no sense here.

    Trump is only able to do this thanks to the fucking Bernie Bots That allowed him to win. Medicare for all will now never happen because the SCOTUS will strike it down.

    And, abortion rights are all but done.

    Trump’s appointments haven’t turned out to be batshit crazy, at least as far as we know. So we have that. :-/

    Elections have consequences. The election people seem to forget is 2014, where Democrats lost nine Senate seats due to the lowest turn-out in a congressional election since 1942. That election led to the current Senate majority for Republicans that has led to two and now probably three conservative justices appointed by Trump to the Supreme Court.

    Yes, it’s awful. But it’s reality. Can’t look back. We all knew RBG’s health was fragile – not a surprise to anyone that she died, right?

    The future may not play out exactly as some people fear. Clarence Thomas is 72. I don’t wish him poor health, but you never know when he or any of the other eight justices may suddenly no longer be on the court for who-knows-why.

    At this point it’s a 99% chance the gop will ram through their nominee. So, what the Dems need to do is win the Senate and have Biden defeat Trump, and they need to cone out now and commit to eliminating the filibuster and adding 4 new liberal judges to the bench. Time for teamwork is over. This is war.

    I agree that it’s about 99% that Republicans will push through the appointment.

    But I’m not sure packing the Democrats packing Court is the right answer. This is a very dangerous, potentially catastrophic change – effectively, it will just let the party who is in the majority add more justices to tip the balance in their favor again. Effectively, the Court will become another political body with decisions being reversed and then reversed again depending on which party is in charge. That will be extremely destabilizing for the nation.

    Don’t assume Republicans won’t be in the majority again soon, assuming Trump loses in November. It could happen again as soon as 2025. Imagine what Republicans could do with no filibuster and the ability to flip the Court again decisively in their favor – and building on the precedent Trump has set of doing whatever you want to win. They could make what Trump has tried to do in rigging the elections look like child’s play.

    We have lived through eras with conservative control of the Court before. And you never know what will happen with the remaining justices. Clarence Thomas is 72 – who knows how much longer he will be around. If anything, the Democrats could use unpopular decisions by the Court to political advantage; if it keeps repealing popular laws the Democrats pass, they can keep blaming Republicans.

    If Democrats do anything, they can try to change the lifetime appointment of Justices to be fixed terms like 20 years. Some experts say this would require amending the Constitution – and that would require a 67% vote by both houses of Congress and ratification by the states.

    The Democrats will have no choice but to pack the court. I agree it’s not a great solution. However, it will be necessary and it is legal. The Republicans did away with filibusters on judges and are out of control. I think the ripple effects down the road are outweighed by the instant necessity. The Supremes have already handed down 80+ 5 to 4 decisions favoring the wealthiest corporations and people in addition to Moscow Mitch ramming through 300 judicial appointments. It is time for Democrats to up the game. In the end it will still be about performing well enough to retain power. If the Democrats retain the House majority and take the Senate, Pres. Biden can move to Amend The Constitution to make additional Supreme Court increases near impossible.

    Elie Mystal of The Nation makes a persuasive argument about adding justices to the Supreme Court – he says to go for it! He would love to see the court expanded into the 20-30 justice range, and he makes some interesting points:

    – A larger judge pool will result in fewer close decisions
    – the court would have the capacity to hear more cases (they have been at 9 since the late 1800’s, while both the Senate, House and WH Cabinet has grown)
    – a larger group of justices can represent a better cross-section of the American people
    – one justice being replaced shouldn’t result in a potentially dramatic ideological rebalancing of the court as it tends to do now, resulting in a more stable, moderate and “just” court.

    If we are going to remain a hyper-partisan nation for the foreseeable future, then a much larger Supreme Court might be one way to mitigate the polarization.

    Trump calling RBG’s last wish, a hoax, isn’t going to help matters with GOP senators facing reelection. Two senators have already said that we need to wait until after the election and there could be more but even so, the democrats have several options to stop it. Trump has had a busy week. Besides the last wish hoax, he was asked by a reporter if he was concerned about the virus because of the large crowds at his rally and he said he wasn’t because he was up on stage and far enough away from them. It didn’t even occur to him that them being in danger was an issue! We can determine from this that not only doesn’t he care about people who disagree with him but his supporters as well! Then, he told a rally that he didn’t think Biden was mentally fit and threatened to put out an executive order that barred him from running for President! He doesn’t have the power to do so(yet)but the crowd cheered so apparently the end of democracy is perfectly fine with them!

    Yup. Pack the court.

    The GOP has been given enough chances.to show it gives a shit. The Dems have rolled over often enough. Clearly the era of thoughtful and deliberate government is over. This country can’t wait for a change of heart in the GOP.

    Well, there’s potential good news: The Manhattan DA may charge Trump with tax fraud! They’ve announced an investigation and want to see eight years of his returns.
